I.- Procedures for online contracting

Esencia Roja, S.L. (hereinafter Mr Delic) requires users to register as customers on the website www.mrdelic.com as a step prior to contracting services and products.

Only people with the necessary legal capacity to sign contracts related to the kind of goods and services proposed on this website can place orders at www.mrdelic.com. The data archived by Mr Delic constitutes proof of all the transactions carried out between Mr Delic and his clients, to which he will confirm by email within a maximum period of 24 hours that his order has been registered.

The Client can consult all the information about the orders placed by accessing his account on the website www.mrdelic.com.

Buying products or services in Mr Delic is very simple: Customers only have to choose the item, add it to the cart by clicking on the «Add to cart» button and process the order following the instructions.

If the customer detects an error in the entry of data of your order must access your account on the website www.mrdelic.com and send us a message immediately on the order that requires any modification.

The entire process of processing and formalizing the contract will be done in Spanish. This document describes the general contracting conditions.


II.- Delivery of orders

The delivery of orders will be made by Mr Delic by his own means or through a transport agency designated by him. Orders will be delivered to the address designated by the buyer, therefore Mr Delic assumes no responsibility when the delivery can not be made as a result of the data provided are inaccurate or incomplete, when the delivery can not be made by absence of the recipient or when the delivery can not be made through the usual access of the property. Notwithstanding the above, Mr Delic will adopt the measures required of a diligent merchant so that delivery can be made as soon as possible, both to the satisfaction of the sender and the recipient.

Mr Delic guarantees the delivery of orders in perfect condition and with the terms indicated in the corresponding section of the website, given the transportation system and the destination chosen by the buyer. On Saturdays, Sundays and holidays there is no collection service or delivery of orders, a circumstance that must be taken into account in the calculation of delivery dates. In periods in which special circumstances occur (dates such as Christmas, transport strikes, extraordinary events …), shipments may suffer some delay. Mr Delic will not be responsible for errors caused in the delivery when the delivery address entered by the Customer is incorrect.

Once the order has left our stores Mr Delic will send an email with the shipping number and a procedure to be able to check at all times the current status of the shipment and location of the package.

Mr Delic does not guarantee deliveries at specific and specific times. If the buyer indicates a specific date of delivery, or within it, shows preference for a specific time slot, it will be understood that it does so for guidance. Mr Delic must communicate this circumstance to the carrier so that, as far as possible, it fits this indication, without assuming any other obligation or liability.

Each delivery is considered carried out from the moment in which the transport company puts the product at the disposal of the Customer, which is materialized through the control system used by the transport company.

In the case of delays in the delivery of the orders attributable to Mr Delic, the Customer may cancel his order in accordance with the procedure described in Section «IV Return and withdrawal». Delays in delivery will not be considered those cases in which the order has been made available to the Customer by the transport company within the agreed period and could not be delivered due to causes attributable to the Customer.

Gift Cards purchased through the Mr Delic website will be downloaded directly by the buyer or will be delivered to the recipient via email at the buyer’s choice. In the latter case Mr Delic is not responsible for the validity of the email addresses provided by the buyer to deliver the Gift Cards.

If the delivery of the product has any problem derived from transport must notify Mr Delic within 24 hours to verify that problem, being necessary to send photographs where they can see the damage.


III.- Price and term of validity of the offer

The prices indicated for each product are total (VAT included) for Spain and they only have to add the shipping costs that, for each destination and transport option chosen, are specified. In the case of orders with delivery address outside of Spain, in the Iberian Peninsula, taxes or additional fees could be applied for certain products according to the country’s legislation, which will be reflected in the order summary before the client makes the confirmation of the same.

The prices are reflected in euros. The prices and conditions stated are valid at all times, and are valid only in the open session, except when a specific date of termination of the offer is indicated on the website. In the order confirmation information, prior to the buyer accepting the transaction, the prices of each of the chosen items are clearly specified, the delivery costs that will be applicable to the operation and the promotions or discounts are specified which, if applicable, are applicable.

The validity of the offer of temporary campaigns and group purchases is usually a few days and the date of completion of the offer is indicated on the website.

IV.- Payment

Payment must be made at the time of placing the order. The initial price that appears on the website for each of the products offered will be added the fees corresponding to the relevant shipping costs and other special taxes for regions or countries outside Spain (peninsula). In any case, said rates will be previously communicated to the Client before formalizing the purchase itself.

The Customer can view the ticket or proof of purchase corresponding to the order on the website www.mrdelic.com in the section «My account», «Orders».

The Customer must pay the amount corresponding to their order by payment through the credit or debit cards accepted or through the PayPal system. Payment can also be made with Gift Cards previously purchased at Mr Delic.


V.- Return and withdrawal

In Mr Delic we work so that our customers are satisfied and enjoy our products, but, sometimes, there may be circumstances that make it necessary to return a product. The conditions of return are:

– Error in any product: if a product is missing or a product has been sent that is not included in the order, we will take care of replacing the correct product as soon as possible without any additional charge or the customer will be refunded the amount.

– Damaged product or packaging: if any product arrives damaged or severely damaged, the recipient must record on the delivery note of the carrier and contact Mr Delic within 24 hours to make timely claims to the insurance we have contracted.

– The product is not expected: simply, without giving us any explanation, our customers have a period of 14 calendar days to return any product, provided it is not perishable. The product must be intact and in its original packaging, the customer being the one who will assume the transport costs of the return.

To proceed with a Return the Customer must notify by email, sending an email to info@mrdelic.com within 48 hours from the receipt of the order.

Gift cards purchased in delivery mode by email or gift cards that have already been fully or partially used to make other purchases can not be returned under any circumstances.

Mr delic will not be responsible for the expenses caused by those returns that occur without respecting the steps established in this procedure.

VI.- Reimbursements to the Client

Mr Delic will manage the refund on the same medium that was used for the payment within a period of 14 calendar days from the moment of receiving the request for withdrawal.

The Client must deliver the goods without undue delay. Mr Delic may withhold the amount of the reimbursement until the goods have been received or until the Customer submits a proof of return of the goods as proof of the transport company, whichever occurs first.

VII.- Guarantee

The products made available to Clients on the website www.mrdelic.com are guaranteed by Mr Delic under the terms established by law.

In case of defective product, Mr Delic will proceed to repair or replace the product. Likewise, Mr Delic may negotiate with the Client the price reduction in case of reaching an agreement or termination of the contract, which will be free for the consumer and user.

The guarantee will lose its value:

– if some of the data of the same or the proof of purchase are modified, altered or replaced.

– if the identification number or the guaranteed product itself is handled or repaired without the knowledge of the Technical Service or the company responsible for the guarantee.

– If you do not have the receipt or delivery note for Mr Delic.

To make use of the guarantee, it is essential to keep the warranty certificate together with the receipt or purchase order from Mr Delic.

The Customer may enforce the guarantee of a product according to the current regulations on the guarantee of consumer products.
